Pollution Liability
Pollution Liability is an extension to the Public Liability insurance that covers injury or damage arising out of the presence of a toxic, hazardous pollutant or contaminant together with the cost of any legal liability for defending an action or claim arising from such accidental seepage, pollution and contamination where such an occurrence is of a sudden or unintended nature.
In some cases this coverage can be extended to include gradual seepage and pollution, although the availability of this coverage is limited in availability to certain classes of risk.
In recent years coverage has been expanded to consider wider Environmental Liability for contaminated land and legacy risks.
Pollution Liability is usually purchased as part of a comprehensive liability package.

Environmental Impairment
By law, the Owner of property may be responsible for cleaning up any pollution or contamination traceable to the Insured’s land or premises. In the event of a latent, undiscovered or subsequently manifest toxic, hazardous substance, pollutant or contaminant being discovered, then this policy will provide protection for liability arising to cover the cost of clean-up and safe removal of toxic substances, pollutants and contaminants and the cost of any fines or penalties associated with such pollution, arising out of an unanticipated and unexpected event.
Such coverage includes protection against unexpected and unanticipated seepage or pollution of contaminants into the water table, water courses, rivers and such like, or arising from an unidentifiable source upstream of the insured property for which the Insured may become liable according to their civil and statutory responsibilities.
